Terms of Sale

These Terms of Sale govern the purchase and use of all Wine-R products, whether purchased directly from Wine-R or through an authorized retailer. By purchasing, installing, or using a Wine-R product, you agree to be bound by these terms.

1. Applicability

These terms apply to all sales of Wine-R cooling systems and accessories in Canada and the United States. They apply whether the purchase is made through wine-r.com, through an authorized Wine- R retailer, or through any other authorized sales channel. Wine-R products are intended for residential use only unless otherwise agreed in writing.

2. Pricing

All prices are listed in the currency indicated at the point of sale and are subject to change without prior notice. Wine-R is not bound by typographical or system errors in pricing. Applicable taxes and shipping charges are the responsibility of the purchaser unless otherwise stated at checkout.

3. Returns

Cooling units are final sale. Due to the nature of refrigeration equipment, Wine-R does not accept returns on cooling units except where the product is confirmed defective under warranty.

Accessories and parts that are unused and in original packaging may be returned within 30 days of purchase for a refund. The purchaser is responsible for return shipping costs. Wine-R reserves the right to apply a restocking fee of up to 15% on returned accessories.

If a product arrives damaged, the purchaser must report the damage with photos within 48 hours of delivery. Claims submitted after this window may not be eligible for a replacement or refund.

4. Warranty Summary

All Wine-R WR2500 cooling systems are covered by a limited 2-year parts-only warranty. Full warranty terms, including coverage details, exclusions, conditions, and the limitation of liability, are available on the Wine-R Warranty page at wine-r.com/warranty. By purchasing a Wine-R product, you acknowledge that you have read and accept the warranty terms.

Warranty coverage requires registration at wine-r.com/warranty within 30 days of purchase.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Wine-R’s maximum liability arising from or related to the sale, installation, or use of any Wine-R product shall not exceed the original purchase price paid by the purchaser for that product.

Wine-R shall not be liable for any incidental, consequential, special, indirect, or punitive damages of any kind, including but not limited to: loss of or damage to wine or other property; water damage;
mold or moisture damage; loss of use or enjoyment; business interruption; or costs incurred by the purchaser for installation, removal, reinstallation, or third-party services.

This limitation applies regardless of the legal theory on which the claim is based, including warranty, contract, tort, negligence, strict liability, or any other theory, even if Wine-R has been advised of the
possibility of such damages.

Some provinces or states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you. In such jurisdictions, Wine-R’s liability is limited to the maximum extent permitted by law.

6. Sizing Responsibility

It is the purchaser’s sole responsibility to verify that the Wine-R WR2500 is correctly sized for the intended wine cellar before purchase. Wine-R provides a BTU Calculator and pre-purchase
consultation to assist with sizing. However, the final decision to purchase is the purchaser’s responsibility.

Wine-R does not accept returns, exchanges, or warranty claims based on inadequate cooling performance caused by rooms that exceed the unit’s rated capacity, rooms that do not meet the
published construction requirements (R-20 insulation, sealed envelope, double-pane glass), or rooms with conditions not accounted for in the sizing calculation.

7. Installation Responsibility

The purchaser is responsible for all aspects of installation, including labor, materials, compliance with local building codes and electrical codes, and any costs associated with accessing, installing, removing, or reinstalling the unit. Wine-R provides installation guidance through its Installation & Care guide but does not perform installations and is not responsible for the quality or compliance of any installation work.

By installing a Wine-R product, the purchaser acknowledges that they have read and agree to these Terms of Sale and the Wine-R Warranty Terms.

8. Force Majeure

Wine-R shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to: natural disasters, pandemics, government actions,
supply chain disruptions, transportation delays, labor disputes, raw material shortages, or any other event that could not have been reasonably anticipated or prevented. Wine-R will make reasonable
efforts to notify affected purchasers and resume performance as soon as practicable

9. Governing Law

These Terms of Sale and any disputes arising from or related to the purchase or use of Wine-R products shall be governed by and construed in accordance with the laws of the Province of
Quebec, Canada, without regard to its conflict of law provisions. The courts of the Province of Quebec shall have exclusive jurisdiction over any disputes arising under these terms.

10. Modifications

Wine-R reserves the right to modify these Terms of Sale at any time. Updated terms will be posted at wine-r.com/terms with the revised date indicated. Continued purchase or use of Wine-R products after such changes constitutes acceptance of the updated terms.
